What is happening
Class Action Italia (ClassIT ETS) is a non-profit association founded by three lawyers. Since 2024 it has been on the Italian Ministry of Justice's list of organisations entitled to bring an azione di classe. Under reference CLASS IT-2026-1, the association is assessing a possible azione di classe against Tesla Italy s.r.l. for Italian owners with Hardware 3 and a purchased FSD package.
No case is pending yet. In a preliminary opinion dated 26 April 2026, which the association publishes as a draft and expressly calls neither a decision nor legal advice, it recommends further investigation before anything is filed. Among the open points it names how an Italian case would relate to the Dutch collective claim. There is no contact or cooperation between HW3 Claim and the association; we know this opinion only from their own website. For now, the association is gathering sign-ups and documents, such as purchase contracts and FSD invoices.
FSD (Supervised) is not approved in Italy. Italy has not recognised the Dutch RDW approval.
What this means for you
If you live in Italy and bought your Hardware 3 Tesla with FSD there, Class Action Italia is the only Italian organisation we know of that is working on this. Whether you register there is your choice. We have no relationship with the association and do not assess it.
An azione di classe is an opt-in procedure: you only take part once you join, within a period set by the court. Joining is still possible after the court has admitted the case. Ask an Italian lawyer how this works in detail.
The Dutch proceedings concern purchases from the Dutch Tesla entity. If you bought from Tesla Italy, that purchase is probably not covered there.
Registering with us does not interrupt the limitation period. If you want certainty about your deadline, ask a lawyer in Italy.
What we do
We record Italian registrations in the worldwide register. We do not represent you legally. For a proceeding in Italy, you need to go to an Italian organisation. We do not run one.
This register receives no fees from participants, does not fund litigation and is not a litigation funder.
This is not legal advice.
