About this initiative
HW3 Claim was set up by Mischa Sigtermans (@mischamartijn on 𝕏). A Dutch Tesla owner and entrepreneur, not a lawyer. After two rejected formal notices and an RDW approval that Tesla only rolls out to AI4, it's time to find other owners.
My situation
In March 2019 I ordered a Tesla Model 3 Performance. In September 2019 I bought the Full Self-Driving package for €6,400. Tesla promised at the time that every Tesla had the hardware needed for full self-driving capability. On 10 April 2026, the Dutch RDW approved the new FSD functionality for Dutch roads. Tesla ships that version exclusively on the newer AI4 hardware. My car, with Hardware 3, doesn't qualify.
What I've tried
I've sent two formal notices to Tesla. Both times Tesla pointed to 'regulation and development' without offering a solution. The RDW approval of April 2026 makes that defence untenable. Tesla ships the approved version exclusively on AI4 hardware; HW3 vehicles would get a stripped-down 'v14 Lite'.
Why this site
One consumer carries little weight against Tesla. Together that changes. This site gathers owners from all over Europe in the same position. The Netherlands leads, but the problem is the same everywhere. The more countries join, the greater the pressure.
Approach
-
We gather sign-ups from HW3 owners (and the older HW2/HW2.5) from all over Europe, with or without a purchased FSD package.
-
In preparing the case, we are assisted by law firm Kennedy Van der Laan.
-
Possible next steps: collective lawsuit or WAMCA procedure (Dutch Mass Damage Settlement Act).
-
You'll be informed in advance and give your own consent before any proceedings.
What this is not
This is not legal advice, a commercial service or a Tesla hate club. It's a factually grounded initiative by a consumer claiming a refund and compensation for what wasn't delivered. And the same for everyone else in the same position.
