What is happening
On 29 May 2026, the Estonian Transport Administration (Transpordiamet) recognised the provisional EU type approval that the Dutch RDW granted on 10 April 2026 for Tesla's driver-assistance system FSD (Supervised). In Europe the system is now called 'Tesla Assisted Driving'. It remains a supervised driver-assistance system: the driver stays responsible.
What this means for HW3
The recognition itself does not name a hardware version. On 23 June 2026 the Finnish regulator Traficom wrote that the system under assessment applies to Tesla models with the latest hardware generation, and that for older cars the manufacturer has not initiated a corresponding procedure (source).
For HW3 vehicles Tesla announced a software version of its own, referred to as 'v14 Lite'. It is not part of the approved version. Tesla sold HW3 cars with the statement that the hardware was capable of fully autonomous driving. Whether and how Tesla makes good on that statement on HW3 is the question the Dutch case is about.
Provisional and national
The recognition applies only in Estonia and is provisional. For an EU-wide approval, the Member States vote in the European Commission's Technical Committee on Motor Vehicles (TCMV). No date for that vote has been set. If the Commission refuses the approval, the provisional approval is revoked six months after that decision (Article 39 of Regulation (EU) 2018/858).
What we do
Owners in Estonia with an HW3 Tesla can register, with or without a separate FSD purchase. We include them in the register and keep this page up to date.
We are not a law firm and do not give legal advice.
